Damning Evidence!



Please be Patient, and Check ALL these postings often. We are sorting out over 20,000 Screen captures representing thousands of research hours. The history of CNET/CBS Interactive promoting Piracy software is staggering. Over 1,000 different software offerings, Several hundred instances of mentioning copyright infringing uses, often with known copyrighted songs or famous band names. Although some of these pages are ten years old, you must remember that CNET has been distributing LimeWire software since at least February 2001.

We have substantial evidence going right up until the year 2011. Moreover, just since CBS bought CNET, they have distributed over 50,000,000 downloads of LimeWire alone! Over 250,000,000 downloads of LimeWire in Total.
Please, keep in mind as you review this evidence, "What was CNET's Intent?"


Good Lord! Shame on you CNET! Napster's body wasn't even cold yet!

Napster shut down it's service on July 27, 2001 in order to comply with a US Federal Court ordered injunction. Look at what CNET's Download.com had allowed to be offered a scant three weeks later!

Not only a "Napster" Clone, but one that had "Napster in it's name, "MyNapster". It garnered 40,087 downloads in it's first few weeks! Posted under the category "MP3 Search Tools", of course, just like LimeWire, KaZaa, Morpheus, Grokster, etc.




CNET's News.com reports a new software offering that mysterious appeared on the internet!

Here, a CNET News.com writer is "reporting" about a mysterious new software program that has appeared on the internet that allows "Napster" users to download ANY type of file, not just MP3 music files! Wrapster is presented as this new and scandalous software that is even reputed to be able to swap "Microsoft Windows 2000"!


Moreover, downloads from CNET's Download.com are first UPLOADED to Cnet's Upload.com and reviewed and tested for several days before posting for download to the public. CNET knew all about what the Wrapster software was for days before it "Mysteriously" appeared on the Internet!


Below, the next image is the same article continued. Notice how slyly the "iMesh" P2P software is brought into the article and compared to Napster. The "iMesh" live in-line link went right to the "iMesh" website, www.imesh.com. Guess which online media giant distributed the majority of all the iMesh software?

However, just as soon as CNET was offering "Wrapster" it became a HUGE and Scandalous news worthy event?



What do you believe the CNET Download.com staff meant by "Share Copyrighted Material Safely"? And CNET had bought ZDNET a few months ago for 1.8 BILLION Dollars! This was not a radical teen or an idealistic College Student! This was one of the very LARGEST Multi Billion Internet Websites.

What do YOU think the Editorial Focus of ZDNET Music was from this List of "How To" guides as ZDNET was being sold to CNET for more than 1.5 Billion Dollars?

Also, look at the URL, GameSpot.com, ZDNET featured the "Music Center" on Gamespot. Why? To appeal to the historic target market of "Music Buyers", Teens? I'd image that a majority of these viewers were 13-15? Minors? Encouraging minors to commit downloading, copyright crimes? YOU DECIDE!

File sharing has been all over the news lately. MP3.com has suffered a major defeat, Napster and Scour are under siege, and CuteMX pulled a "French Army" and surrendered before the fighting even really began. But the lawsuits of the RIAA and the MPAA can't stem the tide. On the contrary, like Xerxes flogging the turbulent waters of the Hellespont, they are simply displaying their hubris. The RIAA may very well succeed in shutting down Napster; the MPAA could crush Scour; UMG may run MP3.com out of business. But for every Hydra head they cut off, three will grow in its place. File sharing is here to stay, because people want it.

And God bless it. You can build a diverse music collection quickly with great downloads such as these. Digitize your LP collection with ease. Sample tunes before purchasing the whole CD, listen to old favorites, or just try something new for the hell of it. File sharing enables listeners to do all of these things with just a couple of clicks.

(*Instead of Top 10, to avoid any problems with that other Dave's lawyers.)

9. Binary Boy It's a safe bet that more geeks than lawyers pay attention to newsgroups. Binary Boy Attachment Finder makes it a snap to find and retrieve movies, pictures, and of course, music from these eclectic message groups. However, the selection can be a bit, well, esoteric.

8. WinMP3Locator Skip sharing altogether and find your MP3s the old fangled way - via Web search engines. My favorite of the search-engine-based finders is WinMP3Locator, which removes duplicate results and verifies links. The process takes a while, but hey, it's still faster than Gnutella (see #6 below).

7. Aimster Aimster integrates with AOL Instant Messenger so you can share files with everyone on your buddy list. Now, what music industry lawyer could object to a little sharing among close personal friends? Oh, yes, Aimster allows grants you full access to the Scour Network (see #2 below).

6. Gnutella If file sharing has a future, it's peer-to-peer, a la Gnutella. Bypass the central server with open source software like this, and there's nobody to sue, nobody to shutdown. One tiny catch: Lately the Gnutella network is hardly working. Increased network use has slowed Gnutella queries to a crawl.

5. ToadNode Several client programs use the Gnutella network. Voyeurs should check out ToadNode, which features a search spy that monitors and displays all keywords sent through the system.

4. FileTopia Take the Napster model, add integrated chat client and instant messaging plus strong encryption, and you have FileTopia. The community of users is growing quickly, and because the server is not in the USofA, it may take a bit longer to shut this one down.

3. Scour Exchange Scour supports more file types than Napster, and you can search for media among the Scour community or the Web. All in all, it's just way too good for its own good.

Nice rant, Dave. I notice you didn't recommend what the recording industry should do to put a stop to this rampant lawlessness. Why not? Because it's WAY too late. The genie is out of the bottle, and all of the RIAA's attorneys will never be able to stuff it back in. So I repeat my original, unrefuted point: Whether it's fair use or illegal is irrelevant; it's here to stay. Period.

Even if by some catastrophe all of your Top 9 disappear, file sharing will continue. Try ICQ: Sending files of any kind is a snap. Before the Napster era, you could find whatever your heart desired on IRC or via FTP. That's still true today: CuteFTP even includes an MP3 finder. Or try most RIAA-toxic of them all, FreeNet. FreeNet is early in development and difficult to use, but it promises secure and anonymous transfer of information over the Internet. Game over.

You see Dave, we live in a democracy, where people can make the law. Unfortunately, it's often the case that big businesses (the recording industry, for example) can ramrod their interests down everybody's throats. But in this case, people like file sharing, and technology makes it easy for them to vote with their mice. That's what makes America great, Dave, and I'm not going to stand by while you badmouth the USA.

The music industry has to come up with a new business model or be relegated to the dustbin of history.

Another Popular software download site, SourceForge, was designed for professional software designers rather than the general public. The downloads were offered for download without promoting them for copyright infringing purposes.

The next Page is a vintage screen capture of "Tucows" from the "Internet WayBack Machine" The downloads were offered in a VERY "Plain Jane" format and the P2P software downloads were not "Hyped" or "Promoted" for Piracy. The Tucows Category for File Sharing Software was under "Internet Utilities" NOT Mp3 Finders as CNET had chosen and promoted.
Moreover, The Tucows software download button often rolled off site for software from a third party server. The site was attractive, but sparse. Tucows focused much more on it's "Web Domain" business more than anything else.

Of Course, CNET categorized P2P File Sharing Software in the "Mp3 Finders" Category, in spite of the fact the software was suitable for sharing many other types of files. When reviewed by CNET staff, the focus was, for years, only on the prowess of each P2P offering, such as Kazaa and LimeWire in procuring only MP3's and known copyrighted music.

The reviews of P2P software were often performed by the MP3 Insider. The focus of these "Smackdown" tests was the ability for each Software Offering to find and download copyrighted SONGS by such artists as "Madonna" "Britney Spears" "Randy Neuman" etc. These tests were performed against the most Notorious Piracy Software offerings such as Kazaa, LimeWire, ,Morpheus, Audiogalaxy, BearShare, Grokster, Etc

A Huge Layoff happened at CNET just as they began to promote the crap out of File Sharing Software. I imagine the reasoning was, File Sharing was viewed as Salvation!
" More Pages Views" + "More Downloads" = "Keep Jobs".

The RIAA and Metallica were the Enemies of this "CNET/ZDNET Gravy Train" that they could NOT afford to LOSE! CNET was hemorrhaging Money in 2000-2002 as File Sharing Software was being "Ramped Up" to a primary Profit source.

The VERY SAME DAY that the New York Attorney General Publicly announces his "Anti Adware" campaign, CNET just happens to have coincidently decided to Ban Adware after allowing it to happen for so long. "We Listened" "We're in your Corner". THAT'S Crap! If CNET cared about the user they would have banned it in 2001! CNET of course offered a "Spyware Center" offering many downloads to get rid of the adware and spyware.

The only former CNET employee I have spoken to said that "KaZaa" was the Program that kept "Giving and Giving" because one download of Kazaa was worth an Adware remover download and an anti-virus download. KaZaa guaranteed CNET's Download.com "Repeat Business".

We WILL find out if CNET allowed Adware from Kazaa and LimeWire because they were making substantial profit from the distribution. CNET claimed it was a COINCIDENCE that they banned Adware the exact same day the NY Attorney General Publicly launched his investigation.

We will find out if it truly "Was" a "Coincidence". LOL

    Isn't inciting someone to commit a crime... uh... a crime?

    So shouldn't the RIAA have sued CNET before going after college students and single moms?

    If CNET and all their cobranded partners got away with this, then why should anyone else be punished for sharing files?
